Could be a case of the engine being probably against the rules, but not definit ively so. They could have it out in a court battle but then neither side wins. So Ferrari “donates” something and the FIA says “It was settled” and everyone moves on.

isnt everyone always cheating in f1?(or at least trying too) ...the big teams just have more resources to put towards new and inventive cheats
